Terms of Use
These are the rules of the road for using Kherpi. We've tried to keep them clear and honest rather than burying things in legalese. That said, these terms are binding — so please read them.
1. The basics
By using Kherpi you agree to these terms. If you don't agree, that's OK — but please don't use the service.
You must be at least 16 years old to create an account. By signing up, you confirm that you meet this requirement.
2. Your account
You're responsible for keeping your login credentials safe. If someone gains access to your account, we can't undo what they do. Use a strong password and enable two-factor authentication if you can.
If you sign up using a third-party provider (Google, Apple, etc.), we receive basic profile information from that provider — typically your name and email address. We don't get your password, and we don't post anything on your behalf.
3. Acceptable use
You can use Kherpi for any lawful purpose. You agree not to:
- Use the service for anything illegal, or to promote illegal activity.
- Upload, store, or share illegal content.
- Attempt to access other people's accounts or data.
- Distribute malware, spam, or other harmful material.
- Harass, abuse, or threaten others.
- Knowingly infringe on anyone's intellectual property.
- Scrape or extract other users' data without permission.
We reserve the right to suspend or terminate accounts that violate these terms. We don't do this lightly, but we will if we have to.
4. Mature content
Kherpi allows you to publish content publicly. If your content is sexually explicit or otherwise "not safe for work," it must be marked as NSFW. We may automatically flag content we detect as mature. Publicly shared content that is illegal or violates these terms will be removed.
5. Your content
Everything you create on Kherpi belongs to you. We don't claim ownership of your notes, documents, or any other content. We only access your content to provide the service (storing, displaying, syncing) — never to sell, train models on, or share with third parties.
When you publish content with a public URL, it becomes visible to anyone with the link. You can unpublish it at any time.
6. API access
Pro users can connect AI agents and tools to their account via our API. API access is subject to fair use — don't use it to hammer our servers or build a competing product. We may introduce rate limits and will communicate them clearly.
7. Privacy & data
We collect only what we need to run the service: your email, username, and the content you create. If you sign in with a social provider, we receive basic profile info from them.
We use cookies to keep you signed in and remember your preferences (like dark mode). We don't use tracking cookies, sell your data, or run third-party ad scripts.
If you're in the EU, you have rights under GDPR — including the right to access, correct, or delete your data. Use the contact form and we'll respond promptly.
You can manage or disable cookies through your browser settings, but doing so may affect the service.
8. Deleting your account
You can delete your account from your settings page at any time. When you do, we permanently delete your documents, folders, media, and personal data. This is irreversible — we can't recover anything once it's gone.
9. Subscriptions & billing
Kherpi offers free and paid plans. By subscribing to a paid plan, you agree to pay the fees shown at the time of purchase.
Recurring subscriptions are billed automatically on your chosen cycle. You can cancel anytime — your access continues until the end of the current period.
Lifetime access means access for the commercially viable lifetime of the service — as long as Kherpi continues to operate. It doesn't mean forever in a cosmic sense. If the service shuts down, lifetime access ends with it.
10. Changes to the service
We may modify, suspend, or discontinue parts of Kherpi at any time. We'll give reasonable notice for significant changes when we can. We may also change features, storage limits, or plan details — we'll make an effort to communicate those too.
If the service is discontinued, no refunds will be issued for previously purchased plans, including lifetime access. We know that's not fun to read, but we want to be upfront about it.
11. No warranties
Kherpi is provided "as is" and "as available." We work hard to keep things running and your data safe, but we can't guarantee:
- The service will be available 100% of the time.
- It will be completely free of bugs or security issues.
- Your data will be preserved indefinitely or protected against every possible loss.
In short: we'll do our best, but we're a small team running a real service, not making promises we can't keep.
12. Limitation of liability
To the fullest extent permitted by law, Kherpi and its operators won't be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill arising from your use of the service.
13. Governing law
These terms are governed by the laws of the Netherlands. Any disputes will be resolved in the courts of the Netherlands, though we'd much prefer to sort things out over email first.
14. Changes to these terms
We may update these terms from time to time. We'll note the date at the top so you can see when they last changed. Continued use of the service after an update means you accept the revised terms.
